Read the 2 denials carefully — they define the line
- 620 Estill (2018, 7-0): builder sought to demolish the sound 1952 Huber/Keeling house; Council liaison: it "was not in disrepair to demolish." The house had just been landmarked (HL18-03) over the owner's objection — designation used defensively.
- 422 S Dooley (2025, 7-0): after-the-fact garage demolition at the 1921 D.E. Box House — punished as unpermitted work, with a face-saving path (favorable consideration promised for a reconstruction CA).
How the 41 approvals actually happened
The Commission almost never says a flat yes to demolition. The recurring deal structures:
- Landmark-for-demolition trades — demolition granted only alongside (or after) an HL overlay recording the history: Cameron Lumber fire site (2012), First Baptist (2015, + redesign + keeping ⅓ of the loading dock), Tickner Apartments (2024, HL24-01 then demo), 512 Estill (2016 — overlay lifted only after a renovation saved the house).
- Non-contributing / derelict structures — 1970s gazebo (2012), failed-slab houses rebuilt as replicas (908 E Wall 2020), the College Street winery/church "eye sore" (CA24-23, 416 E College → 4 residential lots, in your district).
- Partial demo inside renovation plans — rear additions replacing rear walls sail through as "addition" items.
- Relocation as demolition-avoidance — the Commission loves a move: 518 Estill house became a rear-lot garage (2017), McPherson Farmhouse (2016), Bushong Cabin to the Botanical Gardens (2022), Tate House and Winfrey House city relocations (2025).
- Replica anxiety is the pressure point — approvals of demolish-and-replicate draw the dissents (Bunn: "we don't want it to become a replica district," 2023; citizens at Yancey-Stark 2018: "why replace the real thing with a replica?").
Practical doctrine for a College Street owner
- Demolishing a contributing house in sound condition: effectively impossible — expect denial, defensive landmarking, or a months-long tabling war backed by Grapevine Heritage Foundation opposition.
- Demolishing non-contributing or genuinely failed structures: routinely approvable — arrive with the §9 condition/cost exhibits and a designed replacement.
- Never demolish anything first — both denials-with-teeth in the modern record punished unpermitted removal; §12 is $2,000/day.
- The economic-hardship route (§9(c)) is untested in the corpus — no successful hardship application appears in 15 years of minutes. Plan to negotiate, not litigate.
